Service Agreement

 

The Continuous Service Provision Agreement that WHITEBOX S.RL establishes with its clients, governed by the provisions of arts. 1251, 1279 and ccs. of the CCyCN. It is made up of the obligations of reciprocal compliance that constitute the basis of the work we do and is based on our business values and principles, maintaining the character of an affidavit of compliance with its acceptance.

 

ABOUT OBLIGATIONS:

1.- The Client:

You are responsible for the correct use, application and marketing of the information that the company provides you and for the product(s) and/or service(s), being responsible in the same sense for the use, application and marketing that the staff makes of it. at its expense and/or any other user who accesses it through its intermediation and via.

You are obliged to comply with the legal regulations and commercial policies of each country where your products and/or services are marketed for which you have been advised and/or assisted by Whitebox S.R.L.

You understand that possible interruptions, failures, defects or limitations in the provision of the service that Whitebox S.R.L provides may restrict, limit or affect the capabilities or performance characteristics of your business, without implying any responsibility or charge for the company.

You will pay the service in legal time, and must pay the obligation for the immediately preceding month from the 1st to the 10th of each month. In case of default, the active rate for commercial operations will be applied for each day of delay and until actual payment.

 

2) For its part, Whitebox S.R.L:

 

-does not guarantee or make any representation regarding the use and/or the results of use of the services provided to its clients.

-does not guarantee the provision of uninterrupted service/s, free of failures, defects or limitations.

-will not be responsible for damages, losses, lost profits or any consequential damage due to the use of the services provided to its clients and/or the interruption of the contracted service(s), nor against dependents and/or third parties linked to the client. , nor will it be liable for any type of material loss

-will not provide hardware and/or software maintenance service, or support for malfunctions of other systems -not provided by the company- and that affect.

 

ABOUT THE GUARANTEE OF THE PROVISION OF THE SERVICE


The warranty period for the services, developments, products or updates provided to our clients will be fifteen (15) calendar days after delivery or provision of the same, unless expressly indicated in the respective technical proposal accepted by WHITEBOX. S.R.L or support ticket.


ON THE PRESERVATION OF CUSTOMER INFORMATION


It is the client’s responsibility to keep a backup copy of all their files. Likewise, the client and its service users are responsible for their personal data, whether they are located on their personal machines or on equipment or servers maintained by WHITEBOX S.R.L, who will suggest to the CLIENT the best information BackUp policies. that may incur additional infrastructure costs and services outside of the services contracted to the same


ON THE TERMINATION OF THE CONTRACT FOR THE PROVISION OF CONTINUING SERVICES


Bearing in mind that the purpose of contracting the provision of continued services from WHITEBOX S.R.L is for an indefinite period, in the event that the client wishes to terminate it, he/she must reliably notify WHITEBOX S.R.L through any of its means of contact. officials, thirty (30) days in advance of the date on which you wish to cancel, which in any case must coincide with the last day of the calendar month in which takes place, giving rise to payment for the services provided during that period.
